Elmore Wall attorneys represent the surety industry in all aspects of fidelity and surety matters, including performance and payment bond claims and disputes. Our practice is focused primarily on the representation of sureties and contractors, but has also included the representation of owners, payment bond claimants, and bond agents.
We represent sureties in fidelity and surety matters involving statutory bonds and in bond claim disputes involving schools, churches, military bases, hospitals, industrial plants, commercial projects, highways, and bridges. We provide a wide range of services in default, tender, completion, and take-over situations. We utilize recognized consultants who assist in the review of scheduling issues, assessment of quality of work issues, and determine the value of work in place and work to be completed.
Our attorneys are members of national surety claims associations and have presented topics of regional and national interest at national seminars on fidelity, performance bond, and payment bond claim disputes. At the state level, we have drafted legislative amendments to current payment bond statutes and new bond statutes. We assist clients in making an early assessment of their bond claim dispute; we develop a strategy for resolving the bond claim, if possible; and, we vigorously represent their interests in state or federal court if necessary.
