Arbitration and mediation are an increasingly prevalent means of dispute resolution. Many contracts contain provisions requiring arbitration and mediation and many courts now require arbitration and mediation to reduce the court’s caseload.
In arbitration, parties present their cases to selected neutral third parties for a decision on the merits instead of presenting their cases in a court of law. In mediation, a neutral third person assists the parties in reaching an agreement outside of court through an informal resolution process.
